Department for International Legal Cooperation and Cooperation with NATO

In the Department for International Legal Cooperation and Cooperation with NATO, the following tasks and tasks are performed:

  • monitoring of the international legal order, preparation of proposals for initiating a procedure for signing and ratification of international legal instruments with analysis of the legislation,
  • drafting opinions on the need for accession to conventions and protocols within the competence of other ministries;
  • cooperation with the European Committee for the Prevention of Torture and Inhuman or Degrading Treatment or Punishment (CPT), in order to fulfill the obligations contained in the European Convention on Human Rights and to protect against torture and inhuman or degrading treatment or punishment; organizing the visits of the CPT to the courts and prisons, pronouncing its reports on the established conditions and acting upon the recommendations and remarks;
  • continuous cooperation and support to the activities of the Criminal Tribunal for the former Yugoslavia (The Hague Tribunal), as well as in the conduct of investigations and prosecutions of persons accused of serious violations of international norms;

Department of Human Rights and comparative legal analysis

In the Department of Human Rights and comparative legal analysis the following tasks and tasks are performed:

  • activities for the preparation of initial, regular and periodic reports on the compatibility of the national legislation with the ratified international instruments, participation in the defense of the reports arising as an obligation thereof;
  • preparation of reports on realization of the obligations arising from the international documents for national minorities;
  • activities for implementation of recommendations from international organizations, dissemination of relevant recommendations and materials to competent authorities and responsible civil servants, initiating and implementing national activities (proposing legal solutions or other activities) for implementation of recommendations and monitoring their implementation;
  • communication with the competent courts, collection of relevant documentation and other activities on the basis of submitted individual requests against the Republic of Macedonia, before the UN Human Rights Committee;
  • activities for continuous cooperation with international bodies and organizations (UN and CE) their bodies and committees as well as activities for participation in the implementation of programs and projects;

The following tasks and tasks are performed in the enforcement department:

  • preparation of proposals for adoption of laws and preparation of bylaws and other regulations and general acts in the field of enforcement;
  • preparation of reports, opinions, analyzes, reviews, information, records and other materials related to the execution and work of the enforcement agents;
  • performing regular and extraordinary supervision over the work of the enforcement agents and the Chamber of Enforcement Agents;
  • conducting on-site inspection of books, books and objects, the entire record being kept, the use of classified information, the promptness of execution, supervision of the application of the provisions of the Law on Enforcement and the bylaws prescribed by the Minister of Justice;
  • preparation of minutes and reports on the performed surveillance;
  • participation in the preparation of manuals and standards for work by the Chamber of Enforcement Agents;
  • keeping records of the enforcement agents, deputy enforcement agents and the aides of the enforcement agents;
  • preparation of documentation for announcing competitions and election of executors;
  • drafting acts for appointment and dismissal of enforcement agents and keeping records of appointed and authorized enforcement agents;
  • drafting charters for the appointed enforcement agents;
  • preparing a review of the documentation for appointing deputy enforcement agents and for granting consent for assistant enforcement agents;
  • preparation of documentation for issuing ID cards to the enforcement agents;
  • keeping records of persons who have passed the exam for enforcement agents.

In the Notary and Mediation Unit the following tasks and tasks are performed:

  • preparation of proposals for adoption of laws, preparation of bylaws and other regulations and general acts in the field of notary and mediation;
  • preparation of reports, opinions, analyzes, reviews, information, records and other materials related to the notary and the work of notaries and mediation;
  • performing oversight over the work of the notaries public ex officio or on objection of interested persons and supervision of the work of the Notary Chamber of the Republic of Macedonia;
  • carrying out a review of books, registers, directories, records, cases, archives of notaries, the overall record of notaries, the space for carrying out the notary public service and the necessary equipment in notary offices in order to separately control the compliance of notaries in the performance of the notary public service with the provisions of the Law on Notary;
  • drafting minutes for the performed surveillance, proposing measures for removing and sanctioning the identified illegalities in the work of notaries and the Notary Chamber;
  • keeping records of persons who passed the notary exam and the exam for mediators;
  • providing technical support to the Commission for taking the notary exam during the conduct of the exam;
  • preparation of the documentation for announcing competitions and the election of notaries;
  • drafting charters for appointed notaries;
  • drafting acts for appointment and dismissal of notaries and keeping records of appointed and authorized notaries;
  • drafting acts for appointing assistants and deputy notaries;
  • supervising the work of the Chamber of Mediators and preparing a report on the conducted supervision, proposing measures for removing and sanctioning the identified irregularities in the work of the Chamber of Mediators;
  • keeping a register for recording the procedures for mediation.

The Department for Free Legal Aid and the Political System performs activities within the scope of the Ministry that refer to free legal aid, political parties, associations, electoral system, keeping registers for lawyers, associations and legal clinics.

In the Department of Political System the following tasks and tasks are performed:

  • preparation of legal and other regulations from the scope of the electoral system, the referendum and other forms of direct participation of the citizens;
  • preparation of draft laws and other regulations related to the election system, referendum and other forms of direct expression of the citizens, religious communities, as well as for collecting signatures of voters for passing a law and for submitting a proposal for accession to the amendment of the Constitution of Republic of Macedonia;
  • preparation of draft laws and other regulations related to the formation, organization, operation and financing of political parties;
  • preparation of drafts and proposals of laws and other regulations related to the organization and formation of associations and foundations;
  • preparation of reports, analyzes, reviews, information and other materials for the Assembly of the Republic of Macedonia and the Government of the Republic of Macedonia, and other bodies pertaining to political parties, associations, foundations and religious communities;
  • preparing and issuing approvals for use of state symbols and expressions that indicate the name of historical persons and places, nationality, state and its abbreviations, municipality in the Republic of Macedonia or the City of Skopje;
  • acting upon requests in accordance with the Law on Donations and Sponsorship;
  • perform other activities determined by law and other act.

  • ·         deciding upon submitted applications for free legal aid;

  • ·         preparing six-monthly reports on primary and secondary legal aid;
  • ·         informing citizens about using free legal aid;

planning, recording and monitoring of the training, vocational training and            improvement of civil servants, employees of the Ministry;

  • determining and evaluating the economy, efficiency and comprehensiveness of the operation of the financial management system and providing recommendations for improving the operations;
  • preparation of reports and findings for the Minister on the basis of the performed audit.
