Minutes of the Commission for Supervision of AKMIS in Courts Published

Dear All,

We inform you that the Ministry of Justice has published on its website: pravda.gov.mk, the Minutes of the Commission for Supervision of the Application of the Provisions of the Court Rules of Procedure and Supervision of the Implementation of the Provisions of the Law on Case Management in Courts for 2024.

 
Supervision is not just a process - it is a step to ensure fairness and transparency in judicial work.
 
From the inspection of the basic courts and the courts of appeal, it can be concluded that:
  1. The movement of cases in courts in accordance with the law is carried out through AKMIS.
  2. Allocation and reallocation of cases is carried out electronically. No examples of manual allocation of cases have been recorded.
  3. Exemption of judges are carried out according to the legal procedure and on legal grounds.
  4. For each exclusion and inclusion of judges from AKMIS, there are reasoned decisions due to absence longer than five days.
The supervision also identified a number of weaknesses for which the Ministry of Justice submitted recommendations, the implementation of which will be monitored by the commission:
 
  • The courts are facing a shortage of judges and administrative officers.
  • The Judicial Council should conduct an urgent election of judges in order to ensure that the courts are filled with judges.

None of the supervised courts has the systematized number of judicial positions been filled.

  • The courts operate with a shortage of professional associates, IT specialists and archivists.
  • In some of the courts there is no telephone exchange and uniforms are not provided for members of the judicial police. There are no elevators or access for people with disabilities.
  • The courts do not regularly publish work programs, annual plans, schedules and other acts on the website in order to ensure greater transparency of the work of the court.

Measures have been proposed to resolve these problems, and the commission will continue to monitor their implementation.
