The Convention on Agreement on Choice of a Competent Court , adopted within the framework of the Hague Conference on Private International Law in the Hague, on June 30, 2005, aims to ensure the effectiveness of agreement on the choice of a court (also known as "forum selection clauses" or “jurisdiction clauses”), between parties in international trade relations. The Parliament ratified it on August 13, 2024.
With it, the parties are guaranteed that the dispute will be resolved before the court that they chose with an agreement on the choice of a court and that the same judgment will be able to be recognized and enforced in one of the other signatory countries. On the other hand, the state is enabled to implement some of its public policies, in a way that it is guaranteed the respect of several bases for its exclusive competence for certain issues.
The convention represents an instrument that will provide greater legal certainty for cross-border business and create a favorable climate for international trade and investment.
The Convention is also an obligation and from the reports of the European Commission on the progress of the Republic of North Macedonia, as well as the annual meetings of the Subcommittee for Justice and Internal Affairs between the Republic of North Macedonia and the European Union.
