With 64 votes "for", 15 "against" and none "abstaining", the Draft Law for the Council of Public Prosecutors of the Republic of North Macedonia, which is part of the Reform Agenda, was passed in the Parliament.
The proposed legal solution introduces essential innovations aimed at strengthening independence, professionalism and transparency in the work of the Council and the Public Prosecutor's Office as a whole.
The procedure for the selection of members of the Council of Public Prosecutors is being reformed. Clear and transparent criteria are introduced. Their expertise, experience and integrity are guaranteed, according to the criteria provided for in the new Law on the Judicial Council. In this way, the election of the best quality candidates is guaranteed.
An obligation is introduced for a full and reasoned explanation of the decisions for selection, promotion and disciplinary accountability of prosecutors.
A consistent application of the merit system is being introduced - ie merit system, in the election, promotion and dismissal of public prosecutors.
Transparency on the Council is being strengthened by:
• obligation to publish on decisions and reports,
• public performance of sessions,
• direct transmissions and information of the public.
We are introducing a clear two-tier system in disciplinary procedures. The council decides as a second-level authority, and judicial protection is allowed against its decision. This ensures full protection of the rights of public prosecutors, which is a direct response to the recommendations of the European Commission.
The procedure for dismissing the chairman and deputy chairman of the Council is regulated in detail, with specified deadlines and criteria.
The role of the Council in the procedures for the election and dismissal of the Public Prosecutor of the Republic of Macedonia is strengthened. The Council of Public Prosecutors can submit an initiative for dismissal of the Public Prosecutor of the Republic of Macedonia to the Parliament.
The law is part of a broader reform process and is in line with European standards and recommendations, which represents a significant step forward in the process of European integration.
